These unauthorized interventions often lead to dire consequences, including severe infections, suboptimal graft survival, unnatural hairline designs, and irreversible follicular damage. The proliferation of such malpractice underscores the pressing need for stricter regulatory frameworks and heightened public awareness regarding the risks of undergoing hair transplantation at the hands of unqualified practitioners. Through findings from recent clinical studies and documented patient outcomes, this review highlights the significance of seeking treatment from certified medical professionals. While hair transplantation remains a transformative solution capable of restoring not only hair but also confidence and quality of life, it is imperative to exercise caution against the perils of unregulated and inadequately performed procedures.
I. Introduction
Hair loss, medically termed alopecia, is a prevalent condition that impacts both men and women, often carrying profound psychological and social ramifications. While androgenetic alopecia—commonly recognized as male and female pattern baldness—accounts for the majority of cases, various other triggers contribute to hair thinning and shedding. Factors such as chronic stress, hormonal fluctuations, autoimmune disorders, and adverse reactions to medications can all play a role in the progression of hair loss.
The emotional toll of losing hair is substantial, frequently leading to diminished self-esteem, heightened anxiety, and, in severe cases, clinical depression. Individuals who place significant emphasis on their appearance may find the experience particularly distressing, as studies suggest that hair loss is closely linked to body image struggles and social withdrawal. This, in turn, can negatively impact both personal relationships and professional confidence, making everyday interactions feel overwhelming.
For younger individuals, hair loss presents an even greater challenge, as it is often perceived as a sign of premature aging. Feelings of embarrassment and insecurity become intensified, especially in social settings where appearance plays a critical role in self-perception. Moreover, societal beauty standards continue to reinforce the notion that a full head of hair symbolizes youth, vitality, and attractiveness, deepening the psychological distress of those affected.
II. Hair transplantation surgery
Hair transplantation is a surgical procedure for hair restoration that demands specialized expertise. The physician performing the procedure must have completed postgraduate training in dermatology and received comprehensive instruction in dermatosurgery at a recognized center specializing in cutaneous surgery. Additionally, hands-on experience at the surgical table under the direct supervision of a qualified and experienced hair transplant surgeon is essential. Beyond mastering surgical techniques, training must also cover local anaesthesia administration, emergency resuscitation, and post-operative care to ensure patient safety and successful outcomes.2
Hair transplantation involves the transfer of small plugs of hair-bearing tissue into non-hair-bearing areas to promote hair growth. While applicable for scar alopecia coverage, its primary use remains in treating male pattern baldness. The procedure’s success relies on the principle that transplanted hair follicles retain their original growth characteristics even after relocation. In male pattern baldness, the persistent horseshoe-shaped fringe of hair serves as the donor area, from which follicles are moved to balding regions, where they establish and grow.
Before the procedure, the donor area is clipped, and both donor and recipient sites are anesthetized with a local anaesthetic. A circular punch, typically 4 to 5 mm in diameter, is used to extract scalp plugs from both areas. The harvested hair-bearing plugs are then implanted into the prepared bald regions, while the donor site may or may not require suturing. The surrounding hair generally conceals the clipped donor area, ensuring minimal visible signs immediately post-procedure.
After undergoing a hair transplant, tiny crusts form around each graft, persisting for about 10 to 20 days before they naturally detach, revealing faint pink spots beneath. The newly transplanted hairs, nestled within these grafts, often shed between the second and fourth week, creating space for fresh growth that typically emerges around the twelfth week. Complete regrowth, however, can take up to 20 weeks, as it follows the natural rhythm of the original hair’s growth cycle. Over the course of 3 to 4 months, the transplanted follicles gradually blend with the surrounding scalp, though slight differences in texture or color might occasionally be noticeable. The total number of grafts needed varies depending on individual requirements, with each session usually involving 50 to 75 grafts per stage. Over multiple sessions, this can accumulate to a total of 150 to 500 grafts, ensuring optimal coverage and a natural appearance.3
Over the years, hair transplantation techniques have undergone remarkable advancements, with Follicular Unit Transplantation (FUT) standing out as one of the most sophisticated and widely adopted methods. In its initial phases, the procedure relied on large 4-mm punches to extract hair-bearing tissue from the donor region of the scalp. These grafts, often called plugs, comprised multiple follicular units, each housing between 16 to 20 hairs. Once removed, they were carefully implanted into balding areas to recreate a fuller, denser appearance. This approach, though groundbreaking at the time, has since been refined to achieve more natural and seamless results. FUT has since advanced, offering a more precise and natural-looking approach to hair restoration while maintaining its prominence in modern surgical practices. Over time, these large plugs were divided into smaller grafts, but without proper respect for natural follicular unit groupings.4 The modern FUT technique emerged in the late 1980s when Dr. Bobby Limmer introduced the dissection of individual follicular units under a stereomicroscope, leading to more natural-looking results. This innovation set a new standard in hair restoration until the rise of Follicular Unit Excision (FUE) in recent years, which has now become the more popular method. In FUT, a strip of tissue measuring 0.5 to 1.5 cm in width and 5 to 30 cm in length is removed from the back of the scalp. The donor area is then closed with sutures. The harvested strip is meticulously dissected into individual follicular unit grafts, which are then transplanted into balding areas. FUT is known for enabling the transplantation of a large number of grafts in a single session, but it does result in a linear scar in the donor region. 5
Follicular Unit Extraction (FUE) was first introduced in 2002 by William Rassman et al. as a minimally invasive technique for hair restoration, particularly in cases of androgenetic alopecia. This advancement revolutionized hair transplantation by offering a less invasive alternative to traditional methods. Dr. Norman Orentreich, a renowned New York dermatologist, is widely recognized as the "father of modern hair transplantation." His contributions to the field laid the foundation for contemporary hair restoration techniques. He also coined the term "donor dominance," a fundamental concept in hair transplantation. This principle states that hair follicles extracted from the donor area—typically the occipital region of the scalp—retain their original growth characteristics even after being transplanted into a recipient area, allowing for sustained hair growth in the new location.6
In Follicular Unit Extraction (FUE), grafts are harvested individually from the donor area using a two-step or three-step technique before being implanted into the recipient area. This method offers several advantages, including being minimally scarring, promoting faster healing, reducing downtime, and requiring fewer technical staff compared to traditional techniques. 7
Direct Hair Implantation (DHI) is a modified version of Follicular Unit Extraction (FUE), sharing similarities in hair follicle harvesting but utilizing specialized instruments licensed by Konstantinos and specifically designed for this procedure. The implantation phase is performed using a pen-like device with needle sizes ranging from 0.40 mm to 2 mm, allowing precise graft placement. After extraction, each implantation pen is loaded with a micrograft containing 1 to 3 hair follicles and directly implanted into the recipient area without prior perforation. This approach enables denser graft placement, reduces trauma, minimizes bleeding, and eliminates the need for additional punching seen in other transplantation methods. However, DHI has a steeper learning curve, requiring highly skilled personnel. The procedure typically involves 3 to 4 staff members, with each stage assigned to a dedicated specialist, resulting in a more crowded operating room than other techniques. Additionally, the pens and procedure costs are relatively higher than FUT or FUE, though follicle harvesting remains more affordable than robotic-assisted systems. 8
III. Complications associated with hair transplantation
A complication refers to an unforeseen adverse event that strays from the expected progression of a procedure, often necessitating a shift in strategy. In the context of hair transplantation, a cosmetic surgery, even minor complications can profoundly affect the patient’s aesthetic outcomes and emotional state, sometimes escalating to medicolegal disputes. These complications are diverse and can be grouped into several categories: general complications associated with hair transplant surgery, specific issues related to the donor area in Follicular Unit Transplant (FUT), challenges unique to the donor area in Follicular Unit Extraction (FUE), and complications arising in the recipient area. Each category presents its own set of risks, underscoring the importance of meticulous planning and execution to minimize adverse effects.
Anaesthesia related complications
Adverse systemic reactions to local anaesthetics can be categorized into four distinct types: toxic, psychogenic, idiosyncratic, and allergic. Among these, psychogenic reactions are the most common, typically stemming from fear, anxiety, or stress rather than a direct physiological response. True allergic reactions, which involve the immune system, are exceptionally rare. Despite a patient’s history of previous exposure to local anaesthetics, performing sensitivity testing prior to administration is a prudent practice to rule out potential risks and ensure patient safety. This precautionary step helps mitigate the likelihood of adverse events, even in cases where allergic reactions are unlikely.9
Intra operative complications
Intraoperative complications during hair transplantation surgery can range from severe reactions like anaphylactic or vasovagal shock to issues such as drug interactions, excessive bleeding during strip harvesting, bronchospasm, or cardiac events. Tachycardia, often triggered by the adrenaline present in tumescent fluid, is typically short-lived but can become a concern for patients with pre-existing heart conditions. To mitigate these risks, it is strongly recommended that all patients, particularly those over 40 years of age, undergo an electrocardiogram (ECG) and receive a thorough physician evaluation to assess their fitness for anesthesia. Furthermore, continuous monitoring of heart rate and blood pressure is essential throughout the procedure, especially during the administration of anesthesia, to ensure patient safety and promptly address any emerging complications. 10
Pain and edema
Postoperative pain is a common occurrence following hair transplantation surgery, with Follicular Unit Transplantation (FUT) being more associated with pain due to the transection of peripheral nerves during strip harvesting. In Follicular Unit Extraction (FUE), a 3000-graft transplantation procedure typically lasts 6–8 hours, and muscle pain may develop due to prolonged lying positions. To prevent and alleviate pain, short intraoperative breaks, analgesic injections, and postoperative NSAIDs (nonsteroidal anti-inflammatory drugs) are recommended.
Postoperative edema is the most common complication in hair transplantation, with an incidence of 40–50%. Edema results from tumescent anaesthesia and surgical trauma, beginning during the procedure but becoming noticeable 3–5 days later as it descends over the forehead. In some cases, edematous fluid can spread to the periorbital region, leading to periorbital ecchymosis and, in severe cases, preventing patients from opening their eyes. To reduce and prevent edema, patients should be advised on proper lying positions, and the use of massage, cold packs, systemic steroids, infiltrative steroids, and NSAIDs can be beneficial. 11
Any patient presenting with early facial swelling, with or without urticaria, should be evaluated for a possible allergic reaction. Severe cases may involve breathing difficulties and hypotension. Common perioperative drugs that can trigger allergic reactions include antibiotics, NSAIDs, povidone-iodine, and neuromuscular blocking agents. However, allergic reactions to local anaesthetics are extremely rare. In cases of acute urticaria, antihistamines are the first-line treatment, though they act relatively slowly. The anti-inflammatory properties of steroids provide faster symptom relief, making them beneficial in managing acute allergic reactions.12
Postoperative itching
Postoperative itching is a common occurrence in both the donor and recipient areas, often caused by drying and crusting. Frequent saline spray application for 3–4 days can help reduce itching, while head washing aids in effective control. Oral antihistamines can help alleviate pruritus, and topical aloe vera is beneficial for managing dryness. Another rare but notable complication is postoperative hiccups or cough, which may persist for 2–3 days. Though the exact cause is unknown, it is suspected to result from sensory stimulation of the C2, C3, and C4 nerves, which also innervate the diaphragm through the phrenic nerve. Despite the scalp’s rich blood supply, hemorrhage is rare. However, postoperative bleeding may occasionally occur after the patient leaves the clinic. Applying firm pressure with clean gauze for 15 minutes is usually effective in controlling bleeding.
During preoperative evaluation, patients should be screened for a history of bleeding diathesis and the use of aspirin, NSAIDs, vitamin E, alcohol, anabolic steroids, or other anticoagulants. Topical minoxidil and smoking should be discontinued at least two weeks before surgery. Intraoperative recipient-site bleeding is common but can usually be minimized by using epinephrine-containing tumescent solutions. 13 Folliculitis refers to inflammation of hair follicles due to infection, physical injury, or chemical exposure. The reported incidence of postoperative folliculitis in hair transplantation ranges from 1.1% to 20%, with severity varying from mild, superficial inflammation with erythema and scattered pustules to more severe cases. The infection may occur in both the recipient and donor areas.
Treatment depends on the underlying cause. When mild folliculitis appears 2–3 months postoperatively, it is often linked to new hair growth. In such cases, warm compresses for 15 minutes, three times daily, along with a topical antibiotic ointment like mupirocin, is recommended for effective management. 14 other donor and recipient area problems are also common.
Death during hair transplant
Hair transplants are generally considered safe and not life-threatening. Patient safety in hair transplantation is heavily reliant on the surgeon’s skill and the clinic’s adherence to high medical standards. A significant concern is the use of general anaesthesia, which poses a greater risk of severe complications compared to local anaesthesia. Many experts contend that general anaesthesia not only heightens the risk of adverse reactions but also compresses surgical timelines, potentially resulting in hurried procedures and a greater likelihood of errors. To lessen these risks, following stringent anaesthesia protocols and maintaining a scrupulous surgical approach is indispensable for safeguarding patient safety and attaining optimal results. A crucial risk factor in hair transplantation pertains to the quantity of donor grafts collected during a single session. Esteemed clinics generally advise limiting the procedure to 3,000 grafts per day to mitigate potential complications. However, surpassing this threshold can result in dire consequences. A notable incident from 2019, involving an Indian businessman who insisted on the extraction of 9,250 grafts in one day, vividly highlights the perils associated with overharvesting. Exceeding medically advised limits can result in significant trauma, unnecessarily extended surgical durations, and even life-threatening complications. This unfortunate event underscores the imperative for ethical decision-making and careful surgical practices, emphasizing the importance of prioritizing patient safety above all considerations.15 Although hair transplants generally carry a low risk, the likelihood of complications increases significantly when the procedures are conducted by unqualified professionals or in unregulated facilities. Numerous patients seek out cheaper options in developing nations, often without realizing that they may be putting themselves at risk due to insufficient regulatory oversight. Additionally, some clinics engage in “bait-and-switch” tactics, where a renowned doctor attracts patients, only for the actual procedure to be performed by unlicensed assistants. This misleading practice heightens the risk of surgical complications, endangering patient safety significantly. Hair transplant procedures are complex medical interventions that demand a high level of care, precision, and expertise. Therefore, it is crucial to avoid practitioners who do not possess the requisite skills, patience, or meticulousness. Additionally, patients have a responsibility to thoroughly investigate both the clinic and the surgeon prior to proceeding with the treatment. By undertaking this research, they can safeguard their health and well-being by ensuring they are in the hands of qualified professionals, thereby reducing risks and enhancing the chances of favorable results.16
In 2016, Santosh Kumar, a 22-year-old medical student, chose to undergo a hair transplant at an unregulated salon located in Nungambakkam, Chennai. Unfortunately, shortly after the procedure, he suffered severe complications that necessitated his urgent transfer to a hospital, where he ultimately succumbed to multi-organ failure resulting from delayed anaphylaxis and toxic syndrome. Subsequent investigations revealed that the salon maintained unsanitary conditions and that the procedure had been performed by individuals without any formal surgical training or qualifications. This tragic event underscores the significant dangers associated with pursuing cosmetic procedures at unlicensed and unprofessional facilities.17 Similarly, the Delhi High Court gave a mandate to the Ministry of Health and Family Welfare and the Delhi government to take strict action against such unregulated practices. The court stressed the importance of public awareness regarding the dangers of undergoing hair transplantation at the hands of unqualified professionals and emphasized the need for strict medical supervision to ensure patient safety.18
IV. Patient selection and consent
The first step in hair loss management is understanding the patient’s concerns, as they may differ from what appears evident upon inspection. Once the patient has expressed their worries, the doctor can proceed with a thorough examination. After the assessment, the doctor should communicate their findings while considering the patient's expectations and outlining feasible treatment options.
It is essential to explain that hair loss is progressive with age, and patients may require multiple hair transplants throughout their lifetime, depending on its progression. Additionally, long-term medication use may be necessary. Patients must understand that a hair transplant does not create new hair but rather redistributes existing hair, meaning that the density will not match their original hair volume before balding.
The limitations of the procedure should be clearly outlined, especially in cases of advanced baldness, where full coverage may not be achievable. Also, the doctor should inform the patient about alternative solutions to manage hair loss, such as maintaining a shaved look, medical treatments, camouflage techniques like scalp micropigmentation (SMP), or non-surgical options like hair systems and wigs, even if they are not directly provided by the surgeon.19 Every surgical procedure carries some level of risk, even if minimal, and hair transplantation is no exception It is crucial to disclose even the rarest complications, maintaining complete transparency and providing unbiased guidance during consultations. This approach builds trust between patients and practitioners by ensuring clarity and honesty in decision-making. Patients must be thoroughly informed about all available options, empowering them to actively engage in their treatment decisions. Historically, the Bolam test served as a benchmark for assessing whether a medical professional failed in their duty of care, frequently emphasizing medical paternalism at the expense of patient autonomy. However, this criterion has been largely superseded, particularly in the realm of cosmetic procedures, where informed consent and patient autonomy are of utmost importance. Despite these advancements, numerous hair transplant clinics continue to prioritize sales over ethical considerations, utilizing consultants and marketing teams motivated by incentives to draw in clients, which can lead to a disregard for appropriate medical guidance and the well-being of patients.20 Marketing professionals, driven by sales objectives, often make inflated claims regarding the results of hair transplants, leading to unrealistic expectations among patients. The issue is further exacerbated by misleading advertisements in various media and online channels, which propagate misconceptions that frequently do not align with medical truths. Consequently, numerous patients come to consultations with exaggerated or incorrect expectations, which can lead to disappointment when the actual results do not correspond to their idealized perceptions. This disparity highlights the necessity for transparent communication and ethical marketing strategies to ensure that patient expectations are in line with realistic outcomes.21 Setting realistic expectations is fundamental in hair transplant consultations. Patients frequently overlook the fact that promotional results can be deceptive, as various factors influence the outcomes, including the degree of hair loss, the quality of the donor site, and individual biological differences. By educating patients about these elements, they can make well-informed choices, which helps reduce the likelihood of dissatisfaction. To foster trust and enhance patient satisfaction, it is prudent to under-promise and over-deliver, focusing on attainable objectives rather than unrealistic aspirations. Another critical issue during consultations is the presence of body dysmorphic disorder (BDD), where individuals with minimal to no hair loss seek transplantation for unnecessary cosmetic enhancements. In these situations, surgeons must proceed with caution, offering comprehensive counseling and often advising against the procedure. Additionally, when advising younger patients, careful consideration is essential, as their hair loss patterns may still be evolving, rendering early intervention uncertain and potentially problematic. Surgeons, during consultations, may uncover underlying medical issues such as diabetes, hypertension, or cardiovascular problems that are beyond their area of specialization. In such cases, it is crucial to refer the patient to a specialist for a comprehensive assessment to ascertain their eligibility for the surgical procedure.
Informed consent is a crucial legal and ethical obligation in all medical and surgical interventions, including hair transplantation. Neglecting to secure informed consent can lead to accusations of medical negligence. The primary purpose of informed consent is to guarantee that patients have a thorough understanding of their medical condition, the treatment options available, the risks involved, and the anticipated outcomes prior to proceeding with surgery. In the context of hair transplantation, informed consent should encompass several essential elements. This includes a clear explanation of the nature and progression of hair loss, enabling patients to grasp the reasons behind their condition and its potential developments. Furthermore, it should outline the proposed treatment, detailing the specific procedures and techniques to be used—such as Follicular Unit Transplantation (FUT), Follicular Unit Extraction (FUE), or Direct Hair Implantation (DHI)—as well as any supplementary therapies that may be required. Patients should also be made aware of alternative treatment options, including non-surgical methods like medications, wigs, and lifestyle changes. It is imperative to communicate potential risks and complications, such as infections, scarring, unnatural hair growth patterns, shock loss, and depletion of donor sites. Additionally, patients must have realistic expectations regarding success rates, limitations in hair density, and the likelihood of needing future procedures. By thoroughly addressing these components, surgeons can build trust, enhance patient satisfaction, and maintain ethical standards in the practice of hair transplantation. An open dialogue regarding the recovery timeline is crucial, encompassing the length of the healing process, potential side effects such as swelling, scabbing, pain, and folliculitis, as well as the anticipated timeframe for achieving final results. Furthermore, a transparent cost estimation should be provided, detailing expenses related to preoperative assessments, the surgical procedure, postoperative care, and follow-up appointments. By delivering clear, truthful, and thorough information, healthcare providers can maintain ethical standards, build trust, and assist patients in making informed choices regarding their hair restoration journey. 22 By ensuring comprehensive informed consent, both the surgeon and the patient can move forward with mutual understanding and realistic expectations, reducing the likelihood of dissatisfaction or legal disputes.
In the landmark case of Samaira Kohli, the Supreme Court of India highlighted the critical role of informed consent in medical procedures, ruling that doctors must secure explicit and voluntary consent before undertaking any medical intervention. The court stressed that patients must be thoroughly informed about the nature of the procedure, potential risks, possible outcomes, and alternative treatment options to enable them to make well-informed decisions. A general consent form, the court clarified, does not authorize major surgical interventions unless the specific procedure is explicitly outlined. However, an exception applies in life-threatening emergencies where immediate action is necessary to save a patient’s life, allowing doctors to act in the patient’s best interest without formal consent. In Samaira Kohli’s case, a doctor performed a hysterectomy without obtaining her specific consent, a decision the court deemed unlawful. This ruling reinforced the principle that conducting medical procedures without proper consent—except in urgent, life-saving scenarios—could constitute medical negligence or even assault. By establishing this precedent, the judgment significantly bolstered patient autonomy, ensuring that medical ethics in India align with global standards of informed decision-making and the protection of patient rights. This case serves as a pivotal reminder of the ethical and legal obligations healthcare providers must uphold to respect and prioritize patient consent.23
V. Regulations
The Delhi High Court, in the Azhar Rasheed case, ruled that only qualified dermatologists or trained surgeons should perform hair transplants, highlighting risks posed by untrained individuals. The court emphasized informed consent, thorough medical evaluations, and strict medical supervision to prevent malpractice. It called for stronger regulatory oversight of salons performing invasive procedures without medical qualifications. Aligning with this, the NMC’s 2022 guidelines mandate licensed RMP’s for hair transplants, banning unqualified practitioners and unethical marketing while emphasizing hands-on training to safeguard patient safety.24
The National Medical Commission (NMC) mandates that hair transplants be performed exclusively by trained doctors in appropriate medical facilities equipped to handle emergencies. Patients are advised to thoroughly verify the surgeon’s qualifications and gain a clear understanding of the procedure, its associated risks, and the potential need for follow-up sessions. Hair transplantation is a specialized field requiring significant expertise, and it cannot be carried out by untrained individuals. Simply watching instructional videos or attending workshops does not qualify someone to perform such procedures. Additionally, medical assistants involved in the process must receive proper training and operate strictly under the supervision of a qualified doctor to ensure patient safety and procedural integrity.25
VI. Legal remedies
A hair transplant that fails due to medical negligence allows the patient to initiate legal proceedings under the Consumer Protection Act of 2019. This law classifies medical services as "services," thereby including healthcare providers within its jurisdiction. Patients, as consumers, possess the right to lodge complaints against medical professionals for "deficiency in service," which refers to negligent actions, inadequate care, or non-compliance with recognized professional standards. This legal structure enables patients to demand accountability and seek compensation when their confidence in medical treatment is compromised by inferior practices. Remedies available for a failed hair transplant resulting from medical negligence may include compensation for both physical and emotional suffering, reimbursement of medical costs, and recovery of lost wages due to the unsuccessful procedure. Additionally, patients may request a complete refund of the fees paid for the transplant or seek corrective treatment without incurring further charges. This legal framework protects patients' rights and fosters accountability within the healthcare industry, serving as a deterrent against malpractice and unqualified practices in aesthetic procedures like hair transplantation. For patients seeking legal recourse, complaints must be filed in the appropriate consumer forum based on the claim amount. Claims up to ₹1 crore should be submitted to the District Consumer Disputes Redressal Commission, while claims between ₹1 crore and ₹10 crore fall under the jurisdiction of the State Commission. For claims exceeding ₹10 crore, the National Consumer Disputes Redressal Commission is the designated authority. This tiered system ensures that cases are addressed at the appropriate level, streamlining the process of consumer justice and holding negligent practitioners accountable for their actions.26 The complaint must be filed within two years from the date of the incident,27 Patients filing complaints for a botched hair transplant must submit supporting documents, including medical records, bills, and all communication with the doctor or clinic. Under Section 2(11) of the Consumer Protection Act, 2019, "deficiency" is defined as any fault, imperfection, shortcoming, or inadequacy in the quality or manner of service performance, whether legally expected or as promised by the service provider. This provision strengthens the patient's legal position, ensuring accountability for medical negligence and substandard care.28 Since medical negligence falls within this explanation, patients can seek reparation under this Act.
In yet another case29 The State Consumer Disputes Redressal Commission reviewed medical negligence in a hair transplant performed at Delhi Nursing Home. The complainant, Amarbir Singh Bandesha, alleged that the procedure was carried out negligently, leading to unsatisfactory results and further complications. Upon examining the evidence, the Commission found that the clinic had not only failed to properly address the bald area but had also caused additional baldness by over-harvesting the donor region. As a result, the complainant had to seek corrective treatment elsewhere. The Commission ruled in favor of Bandesha, ordering a refund of the procedure cost along with compensation for the physical and mental distress endured. Delhi Nursing Home's appeal was dismissed, holding them accountable for their deficient service.
State Consumer Disputes Redressal Commission of Chandigarh 30 The reviewed an appeal filed by Richfeel Health & Beauty Pvt. Ltd. against a ruling by the District Consumer Disputes Redressal Forum-I, U.T., Chandigarh. The case stemmed from a complaint by Vikas Kumar, who underwent a hair transplant at Richfeel’s clinic in April 2017, paying ₹70,948. Despite being promised visible hair growth within six months, he saw no improvement and instead suffered from scalp infections. The District Forum ruled that Richfeel was deficient in its services and ordered a refund of the treatment cost, along with compensation for mental distress and litigation expenses. Upon appeal, the State Consumer Disputes Redressal Commission upheld the District Forum’s decision, affirming that Richfeel Health & Beauty Pvt. Ltd. was indeed deficient in its service. The Commission agreed that the company had failed to deliver the promised results and had caused undue distress to Vikas Kumar. Consequently, the appeal was dismissed, and Richfeel was held liable for providing inadequate treatment.
VII. Criminal liability
If an untrained individual performs a hair transplant, it could result in criminal liability under the Bharatiya Nyaya Sanhita (BNS) due to negligence, bodily harm, or even fatal consequences. Conducting hair transplants without proper qualifications may also lead to charges of cheating, grievous hurt, or culpable homicide, depending on the severity of the harm caused. Section 106 of BNS, 2023, specifically addresses causing death by negligence, stating that anyone whose reckless or negligent act results in death—without amounting to culpable homicide—can face imprisonment for up to five years along with a fine.31 This provision replaces Section 304A of the Indian Penal Code (IPC), 1860, which prescribed a maximum imprisonment of only two years for causing death by negligence.32 The Bharatiya Nyaya Sanhita (BNS) adopts a stricter stance on negligence-related fatalities, imposing harsher penalties for medical malpractice, reckless driving, and other hazardous professional misconduct. Section 106 particularly addresses cases where a reckless or negligent act leads to death, prescribing imprisonment of up to five years and a fine. This broader scope ensures greater accountability, especially in cases like botched hair transplants by untrained individuals, fatal road accidents, or unsafe construction practices. The increased penalties serve as a deterrent, reinforcing justice and public safety by discouraging reckless and irresponsible behavior.
VIII. Conclusion and suggestions
This paper underscores the importance of patient safety, proper training, and legal compliance in hair transplantation. While the procedure offers significant aesthetic and psychological benefits, it carries risks, especially when performed by unqualified individuals in unregulated settings. Legal frameworks like the Consumer Protection Act, 2019, and the Bharatiya Nyaya Sanhita (BNS) provide avenues for redressal in cases of medical negligence, with judicial interventions emphasizing the need for qualified professionals.
To ensure safer and more effective hair transplantation, stricter regulations should be enforced, restricting the procedure to licensed medical practitioners. Public awareness campaigns must highlight the risks of unqualified practitioners, urging patients to verify credentials before undergoing surgery. Standardized training and certification programs should be implemented, requiring practitioners to stay updated on technical and ethical aspects. Informed consent must be prioritized, ensuring patients understand the risks, benefits, and potential complications. Clinics must adopt ethical advertising practices, avoiding exaggerated claims about results. Facilities performing hair transplants should be equipped for medical emergencies, with trained personnel readily available.
Patients who experience botched procedures should be made aware of their legal rights and avenues for compensation, while stronger legal frameworks should ensure swift redressal. Additionally, continued research and technological advancements, such as robotic-assisted systems, can enhance precision and minimize complications. By implementing these measures, the medical community can maintain the integrity of hair transplantation, ensuring it remains a safe and effective option while reducing the risks associated with unregulated practices.
